End-User Subscription Agreement (EUSA) for in2Era.com.au
Important: please read the terms and conditions of this subscription agreement carefully before continuing to access this product.
This Era Books End-User Subscription Agreement (EUSA) is a legal agreement between you (either an individual or a legal entity) and Era Books for the Era Books software product identified above, which may include associated software components, media, printed materials, and online or electronic documentation.
By accessing in2Era.com.au, you agree to be bound by the terms of this EUSA. This subscription agreement represents the entire agreement concerning the program between you (referred to as 'Subscriber' and Era Books (referred to as 'Publisher'), and it supersedes any prior proposal, representation, or understanding between the parties. By agreeing to the terms of this EUSA you are agreeing on behalf of all other parties who access the software product using this user subscription.
If you do not agree to the terms of this EUSA, you are not permitted to access or use the software product. Contact Era Books if you do not agree to these terms.
The software product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The software product is sold as an annual subscription service.

Subscription access and use
The software product is provided as follows:

Access and use
Era Books grants you the right to access and use the software product on any computer for the term of the subscription using your Subscriber ID and Password, and to save, print and communicate any illustration and/or text created by the Subscriber using tools provided within the software.

User subscription types: Schools

Era Books hereby grants you the Subscriber a non-exclusive, non-transferable subscription on the terms in this EUSA to use the software product for its intended purpose only. You may use the software product on a maximum of two hundred (200) computers simultaneously, solely for use within your institution.

User subscription types: Public libraries

Era Books hereby grants you the Subscriber a non-exclusive, non-transferable subscription on the terms in this EUSA to use the software product for its intended purpose only. You may use the software product to serve your library members via a link to in2era.com.au on your institution's website.
- A Public Library Subscription Holder may use the Era Books logo and the in2Era brand image to promote to its membership the in2Era online products that are subscribed to by the Library for the duration of the subscription provided that the images are not altered or used for any other purpose. Upon request, Era Books will supply appropriate digital files to the Subscriber.

Description of other Limitations
The Subscription Holder may not:
- Remove or alter any copyright notices on any and all copies of the software product.
- Distribute registered copies of the software product to third parties.
- Reverse engineer, decompile, or disassemble the software product.
- Rent, lease, or lend the software product.
- Unless under a Copyright Agency Limited (CAL) subscription, copy, download, print, save, store in a retrieval system, publish, transmit, or otherwise reproduce, transfer, save store, disseminate or use, in form or by any means, any part of the data contained within the software product.

Support Services
Era Books may provide you with support services related to the software product.

Compliance with Applicable Laws
You must comply with all applicable laws regarding use of the software product.

Termination
Without prejudice to any other rights, Era Books may terminate this EUSA if you fail to comply with the terms and conditions of this EUSA. In such an event, your access to the software product will be terminated.

Copyright
© Era Books 2022. All rights reserved. The software product and all data, documentation and other materials contained in it together with the accompanying materials and all intellectual property therein are the property of Era Books or its suppliers and are protected by law.

No Warranties
Era Books expressly disclaims any warranty for the software product. The software product is provided 'as is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. Era Books does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the software product. Era Books makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or another such computer program. Era Books further expressly disclaims any warranty or representation to authorised users or to any third party.

Limitation of Liability
In no event shall Era Books be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of authorised users' use of or inability to use the software product, even if Era Books has been advised of the possibility of such damages. In no event will Era Books be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract or otherwise. Era Books shall have no liability with respect to the content of the software product or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
